Organizer Terms

Version of · effective upon publication

Terms for those who connect a channel or group and run activities through Vitrina: responsibility for prizes and the lawfulness of the promotion, Vitrina's rights to channel materials, Premium, cross-promo, the home feed and participant data.

This English version is a translation provided for convenience. If it differs from the Russian version, the Russian version prevails (clause 13.4 of the Terms of Use).

1. General provisions

1.1. These Terms supplement the Terms of Use and apply to Organizers and the members of their teams. Terms are used as defined in the Agreement.

1.2. The Organizer accepts these Terms when they connect a channel or group, create an activity, confirm the rules before launching an activity or join an activity’s team. Confirming the rules before the first launch is a separate confirmation of these Terms.

1.3. The Organizer acts in their own name and at their own risk. If the Organizer acts on behalf of a company, they confirm their authority, and the company is bound by these Terms.

2. The Organizer is responsible for the activity

2.1. The Organizer is the sole organizer of their activity. They independently determine its terms, timing, prizes and delivery procedure and are responsible for them to Participants, third parties and public authorities.

2.2. The Organizer warrants that their activity and prizes comply with the law of every country where the activity is held and where its Participants live. In particular, the Organizer, independently and at their own expense:

  • checks whether the activity is a lottery, gambling or any other event requiring a permit, notification or registration, and meets those requirements;
  • complies with the requirements for promotional campaigns, advertising (including ad labeling and reporting), consumer protection and personal data;
  • performs the duties of a tax agent and any other tax obligations related to prizes, where they arise;
  • complies with age and other restrictions on prizes: does not give alcohol, tobacco and other restricted goods to persons who may not receive them, or in forms prohibited by law;
  • publishes the rules of their activity where the law requires it.

2.3. If an activity involves a purchase — for example, the Organizer gives out tickets or codes for tries together with goods or services — the Organizer is solely responsible for the legal classification and lawfulness of such a promotion. The Operator does not sell tries or chances to win.

2.4. The Organizer must not:

  • run gambling, lotteries or other unlawful draws through the Service, or sell participation or chances;
  • promise prizes that do not exist or give false descriptions, value, timing or terms;
  • require Participants to pay for participation or for receiving a prize, or to provide excessive personal data;
  • use an activity for fraud, data harvesting, spam, artificial inflation or other abuse;
  • breach Telegram’s rules, the Content and Moderation Rules or the law.

3. Prizes

3.1. The Organizer must provide prizes to winners as described, within the stated time and in the stated manner, and, where no time is stated, no later than 7 days after the winner’s request. The Organizer keeps the prize activation methods (codes, links, contacts) working and responds to winners’ requests.

3.2. The Organizer records the delivery of prizes in the «Победители» (Winners) section and keeps evidence of delivery for at least one year.

3.3. The Operator is not a party to relationships concerning prizes and is not liable for their availability, quality, delivery or the consequences of their use.

3.4. If the Organizer fails to deliver prizes or violates Participants’ rights, the Operator may:

  • stop or block the Organizer’s activities;
  • restrict features and block the Organizer’s account and channels in the Service;
  • inform Participants of the breach, including publicly;
  • disclose information about the Organizer to Participants and public authorities where provided by law.

3.5. The Organizer shall indemnify the Operator for all claims, costs and losses related to the Organizer’s prizes and activities.

4. The channel and rights to materials

4.1. The Organizer confirms that they are entitled to manage the channel or group they connect and grants the Vitrina bot the administrator rights required for the Service to work.

4.2. The Organizer grants the Operator a license to Content on the terms of section 7 of the Terms of Use. The license also covers the channel’s name, description and avatar, activity posts, and the names, descriptions and images of prizes.

4.3. Without additional consent or remuneration, the Operator may:

  • show activities, prizes and the channel in the Service, on the Vitrina home feed, in cross-promo, collections and mailings;
  • use the channel’s name, avatar and description, activity results and anonymized statistics in case studies, on the website, in Vitrina’s channels, in advertising and in materials for partners;
  • publish the Organizer’s activities in Vitrina’s channels and talk about them.

4.4. The Organizer may ask not to use their channel in case studies by writing to @vitrina_manager or info@vitrinarandom.com. The Operator will stop new use within a reasonable time; the Operator is not obliged to remove materials that have already been published.

5. Moderation, the home feed and cross-promo

5.1. The Vitrina team may review any activity, including manually, and at its discretion limit its display, suspend, stop or block it.

5.2. Showing an activity on the Vitrina home feed, in the Editor’s choice, Top and New collections and among random activities is a right, not an obligation, of the Operator. The Operator decides on display, order and timing at its discretion and may stop the display at any time.

5.3. The Operator may add partners’ bonus prizes to the winners of activities under the cross-promo rules. Bonus prizes do not reduce the Organizer’s prizes and do not change the chances in their activity.

5.4. If the Organizer marks their prize for cross-promo, the Operator decides the number of units and where they are shown. Cross-promo units are deducted from the prize’s total quantity. The Organizer must deliver such a prize to the winners of other activities on the same terms as to their own.

6. Participant data

6.1. The Organizer gets access to the data of their activity’s Participants: Telegram name and username, ID, participation history, wins, tags and exports. The Organizer may use this data only to run the activity and deliver prizes.

6.2. For the data that the Organizer receives, exports or requests from winners to deliver a prize, the Organizer is an independent controller of personal data. The Organizer complies with personal data law, does not sell or transfer the data to third parties, and does not use it for mailings without the Participant’s separate consent.

6.3. The Organizer is responsible for the actions of their team members and grants access rights at their own risk.

7. Premium and paid features

7.1. Paid features work for activities whose owner has a Premium subscription. The scope of the subscription, prices and terms are shown in the mini app at the time of payment.

7.2. Payment is made in Telegram Stars. The subscription starts after payment; a renewal adds time to the remaining period. When the subscription ends, paid features are switched off.

7.3. Payments are non-refundable, except where the service was not provided through the Operator’s fault. If the account is blocked for a breach, the paid period is neither refunded nor compensated.

7.4. Rewards for invitations, including Premium days, are granted at the Operator’s discretion. The Operator may change and discontinue the reward program and cancel rewards obtained in breach, including through fake accounts and invitations.

8. Draw results

8.1. The results of tries are determined by the Service’s algorithm according to the rules the Organizer set before launch or changed during a pause. The Organizer may not demand that results be changed, that a winner be chosen manually or that a win be cancelled, except where a Participant has broken the rules.

8.2. The Organizer may block Participants who break the rules, such as cheaters and multi-accounts. The decision to block and its consequences are the Organizer’s responsibility.

9. Liability

9.1. The Organizer bears full responsibility for their activities, prizes, Content, channel posts, advertising, Participant data and the actions of their team.

9.2. The Organizer shall indemnify the Operator for losses, costs (including legal fees), fines and amounts of claims by Participants, third parties and public authorities related to the Organizer’s activities, prizes and breach of these Terms.

9.3. Limitations of the Operator’s liability are set out in section 9 of the Terms of Use.
